ORDER
This writ petition is filed seeking a writ of certiorari to set aside the award dated 21.07.2000 passed in I.D.No.57 of 1996 by the Industrial Tribunal-cum-Labour Court, Godavarikhani. 2.
Heard learned counsel for the petitioner and learned Standing Counsel for the respondents.

Learned counsel for the petitioner contended that after enquiry, the petitioner was removed from service for proving misconduct and thereafter, he preferred an appeal, wherein the appellate Court has modified the order of removal to that of fresh appointment and challenging the same, the petitioner filed I.D.No.57 of 1996 and the same was dismissed.

The material on record would show that while the petitioner was working as Conductor on contract basis, he was removed from service on the ground of his absence from duty without intimation. After enquiry, he was removed from service and the appellate authority has modified the punishment of removal from service to that of fresh appointment.

Since the petitioner was already reinstated into service in pursuance of the orders of the appellate authority, this Court is of the considered view that there are no merits in the writ petition.

Hence, the Writ Petition is dismissed. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand dismissed.
