THE HON'BLE JUSTICE G.SRI DEVI CRIMINAL PETITION No.2584 of 2019 ORDER:

This Criminal Petition under Section 482 of Cr.P.C., is filed by the petitioners/A1, A2, A4 and A5 seeking to quash the proceedings in C.C.No.473 of 2016 on the file of II Additional Judicial First Class Magistrate, Nizamabad, registered for the offences under Sections 420, 419, 468, 471 IPC, against them. 2.

Heard learned counsel for the petitioners/A1, A2, A4 and A5, learned Additional Public Prosecutor representing the 1st respondent-State and perused the record.

Learned counsel for the petitioners, after arguing the matter for some time, requested this Court to dispense with the appearance of the petitioners/A1, A2, A4 and A5 in the aforesaid case before the trial Court.

Learned Additional Public Prosecutor submits that the presence of the 1st petitionber/A1 may not be dispensed with as he is prime accused in the aforesaid case.

In view of the aforesaid submissions, the appearance of the petitioners/A2, A4 and A5 in C.C.No.473 of 2016 on the file of II Additional Judicial First Class Magistrate, Nizamabad, is dispensed with, except on the dates whenever their presence is required by the trial Court and they shall be represented by their counsel.

With the above direction, the Criminal Petition is disposed of.

Miscellaneous petitions, if any pending in this criminal petition, shall stand closed.
