E.Pratap Sen (E.No.52708) v. The A.P.S.R.T.C.,

HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P. No. 6361 of 2002 O R D E R:- This writ petition is filed seeking to issue a writ of certiorari calling for the records relating to the Award dated 31.10.2001 in I.D.No. 300 of 1986 passed by the Industrial Tribunal-cum-Labour Court, Warangal and quash the same by holding it as arbitrary and illegal. A consequential direction to the respondents to reinstate the petitioner into service with continuity of service and all consequential benefits is also sought.

When the matter is taken up for hearing, it is reported by the learned Standing Counsel for A.P.S.R.T.C. appearing on behalf of the respondents that the petitioner has already retired from service on attaining the age of superannuation, as such, the cause in this writ petition no longer survives and the matter has become infructuous.

In view of the above submission, the writ petition is dismissed as infructuous. However, it is made clear that if the petitioner is entitled to any other benefits for the services rendered with the Corporation, the same shall be paid by the respondents, within a period of four weeks from the date of receipt of a copy of this order. No order as to costs. As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
