M/S. Venkateshwara Jaggery Merchants, v. The State Of Telangana

THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.30669 OF 2015 ORDER:

The prayer of the petitioners in this case is as under: "For the reasons stated in the accompanying affidavit, the petitioner herein prays that this Hon'ble Court may be pleased to issue an appropriate Writ, Order or Direction more particularly one in the nature of Mandamus, declaring the action of the respondents police in interfering with the petitioners business in jaggery and black jaggery and threatening to open the rowdy sheets and threatening to bind over before the Tahsildar without any authority or jurisdiction in contravention of the provisions of Section 56 and 567 of the A.P. Excise Act, as violation of their own circular dt.22.12.2010 as the same is illegal, and arbitrary, and consequently direct the respondents police not to take any coercive steps in contraventions of the provisions of A.P. Excise Act, and to grant such other relief or reliefs as this Hon'ble Court may deem fit and proper in the circumstances of the case."

Sri Praveen Kumar Veerjala, learned counsel for the petitioners, states that in the light of the counter-affidavits filed by respondents 3 and 7 and, more specifically, what has been stated in para 5 of the counter-affidavit filed by the third respondent, the Additional Superintendent of Police (Operations), Nalgonda, and in para 4 of the counter-affidavit filed by the seventh respondent, the Prohibition and Excise Inspector, Station House Officer, Devarakonda, Nalgonda District, the petitioners would workout their remedies in accordance with law.

Recording the said statement, the writ petition is closed. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
