Heard Sri V.R.Reddy Kovvuri for petitioner, Sri G.Seshadri for 1st respondent and the Assistant Government Pleader for Revenue for 3rd respondent.

The petitioner prays for Mandamus declaring the action of respondents in attempting to dismantle the residential house bearing D.No.4-500 (old No.4-432) at Sodam Village, Chittoor District, without recourse to law, as illegal, arbitrary and unconstitutional. On 24-02-2012, the possession of petitioner of subject matter of writ petition is protected by interim order and the same is subsisting as on date.

I have perused the affidavit and annexures filed in the writ petition and also the stand taken by respondents 1 and 3. Without expressing any view on the merits of the fact in issue between the parties, bearing in view the settled position of petitioner of residential house bearing D.No.4-500 (old No.4-432) at Sodam Village, Chittoor District, I am satisfied the writ petition can be disposed of by this order.

The possession of petitioner of residential house bearing D.No.4-500 (old No.4-432) shall not be disturbed except in accordance with law.
