THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR Writ Petition No.2569 of 2015 Order: (per the Hon'ble the Chief Justice Sri Kalyan Jyoti Sengupta) No counter affidavit is required to be filed in this matter as we are of the view that the enquiry report, which is challenged is good enough.

We are of the view that in the facts and circumstances of the case, the recommendation of the punishment by the Enquiry Officer is not warranted. Therefore, we delete the sentence starting with the word "and charged staff member deserves major penalty" and also delete the sentence in paragraph-23 of the report starting with the word "she does not deserve for any sympathy or lenient view". They should not be relied at all and the rest of the portion of the report of the Enquiry Officer shall remain as it is.

The writ petition is accordingly closed.
