HONOURABLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.10656 OF 2011 ORDER:

This writ petition is filed seeking to issue a writ of Mandamus declaring the action of the 1st respondent in causing inordinate delay in paying the balance GPF amount, as illegal and arbitrary, and consequently, to direct the respondents to pay the balance amount along with interest.

Heard Sri K. Udaya Sri, learned Counsel for the petitioner and the learned Government Pleader for Finance and Planning. 3.
It is the case of the petitioner that he worked with the respondents and he retired from service on 28.2.2007 as Work Inspector while working in the 3rd respondent-office. The grievance of the petitioner is that the respondents have not paid the entire GPF amount even though he retired way back in the year 2007 and therefore, appropriate orders may be passed directing the respondents to pay the balance GPF amount. 4.
The learned Government Pleader for the respondents contended that the entire amount was paid to the petitioner and no amounts are due to the petitioner and that there are no merits in this writ petition and this petition is liable to be dismissed.

This Court having considered the rival submissions made by the parties, is of the view that ends of justice would be met if this writ petition is disposed of directing the petitioner to submit a fresh representation to the respondents.

Accordingly, the Writ Petition is disposed of directing the petitioner to submit a fresh representation to the respondents with the regard to the balance GPF amount, within two weeks from the date of receipt of a copy of this order. On such representation being received, the respondents shall consider the same and pass appropriate orders, within a period of four weeks thereafter. No costs.
