THE HON'BLE Dr . JUSTI CE SHAMEEM AKTHER CI VI L REVI SI ON PETI TI ON No.1 2 0 6 OF 2 0 1 9 ORDER:

This revision, under Article 227 of the Constitution of India, is filed by the petitioner/ respondent aggrieved by the order dated 05.03.2019 passed in I.A.No.815 of 2018 in O.P.No.51 of 2017 by the Judge, Family Court, Nizamabad.

2.

Heard the learned counsel for the revision petitioner and perused the record.

3.

Learned counsel for the revision petitioner-husband would contend that the interim maintenance granted to the respondent-wife and daughter @ Rs.8,000/ - and Rs.2,000/ - per month respectively is excessive and ultimately prayed to set aside the impugned order. 4.

There is no dispute that the revision petitioner is working as Scientific Assistant in the Nuclear Fuel Complex, ECIL, Hyderabad. In the course of submissions, it is submitted by the learned counsel for the revision petitioner that the revision petitioner is drawing monthly salary of Rs.39,000/ -. The daughter of the revision petitioner is a School going girl. The respondent-wife has no source of income. It is the duty of the revision petitioner to maintain his wife and daughter. Nowadays, the cost of living is high. The rents of the house are also high. More expenses are being incurred to pursue any education. Hence, the grant of maintenance as indicated above is not excessive. There is no infirmity in the impugned order. The Court below is justified in granting the said amounts. Under these circumstances, the Civil Revision Petition is devoid of merit and is liable to be dismissed.

5.

In the result, the Civil Revision Petition is dismissed. The Miscellaneous Petitions, if any, pending shall stand closed. No costs.
