THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 21930 of 2016 ORDER:
Heard learned counsel for the petitioner and learned Government Pleader for Home.
With the consent of both the parties, the Writ Petition is disposed of at the admission stage.
The present Writ Petition came to be filed with the following prayer:
'For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue a Writ or order or direction more particularly one in the nature of writ of Mandamus declaring the inaction of respondent No.3 in investigating and arresting the accused in FIR No.55 of 2016 dated 04.03.2016 lodged by the petitioner as arbitrary, illegal, in violation of the provisions of Cr.P.C. and Article 14 of the Constitution of India and consequently directing respondent No.3 to investigate in pursuance of FIR No.55 of 2016 dated 04.03.2016 against the accused and take appropriate legal action including arrest of the accused as per the provisions of Cr.P.C. in the interest of justice and pass such other order or orders as this Hon'ble Court may deem it fit and proper in the circumstances of the case'.
Though various grounds are raised, learned counsel for the petitioner restricts his prayer seeking a direction to the respondent-police to complete the investigation in Crime No.55 of 2016, at the earliest. Learned Government Pleader submits that she has no objection for the same.
Having regard to the above, the writ petition is disposed of directing the respondent-police to complete the investigation and file a final report in Crime No.55 of 2016, as early as possible, in accordance with law.
Miscellaneous petitions, pending if any, shall stand closed in the
