THE HON'BLE SRI JUSTICE SANJAY KUMAR CONTEMPT CASE No.1041 of 2016 ORDER:
This Contempt Case was filed alleging willful disobedience to the order dated 07.04.2016 passed by this Court in Writ Petition No.11485 of 2016. By the said order, this Court directed the police authorities to take necessary action upon the complaint dated 29.02.2016 of the petitioner in terms of the law laid down by the Supreme Court in LALITA KUMARI v. GOVERNMENT OF UTTAR PRADESH[1].
The Inspector of Police, Medipally Police Station, Cyberabad, Telangana, filed a counter-affidavit stating that upon the subsequent complaint dated 14.07.2016 received from the petitioner, FIR No.431 of 2016 was registered on the file of Medipally Police Station, Cyberabad, under Sections 447 and 427 IPC read with Section 34 IPC. It is fairly stated that complaint dated 29.02.2016 was not received.
In the light of the afore-stated developments, this Court finds no disobedience, much less willful disobedience, to the order passed by this Court warranting exercise of contempt jurisdiction.
The Contempt Case is accordingly closed.
Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
