HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.3715 of 2017 ORDER:
This petition is filed for a writ of Mandamus declaring the action of the respondents 2 to 5 in not taking any action on the representation of the petitioner's counsel dated 24.11.2016 for conducting survey and remove the wall across the road in-front of the petitioner's house site plots for ingress and egress situated at Survey No.249 and 251 at Lakshminagar Colony, Mahabubnagar town and District, as illegal and arbitrary and for a consequential direction to the respondents 2 to 5 to remove the wall across the road infront of the petitioner's house site plots. Learned Assistant Government Pleader for Revenue produced written instructions stating that the District Scheduled Caste Co-operative Services Development Society has constructed the boundary wall around the subject property and that the Tahasildar has no say in the matter. He further states that unless the said society is made as party, no directions can be issued in the writ petition.
In view of the aforesaid facts and circumstances and in view of the fact that the petitioner has not filed any approved lay out showing the road, this Court cannot issue
any direction. Accordingly, the writ petition is dismissed. No order as to costs.
