HONOURABLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.544 of 2017 ORDER:

Grievance of the petitioners is that by mortgage deed document No.538/2016, dated 20.02.2016 in pursuant to L.P.No.32/2016, certain plots were mortgaged by the petitioners and even though all the statutory requirements are complied by the petitioners, those plots are not released, causing undue hardship and suffering to the petitioners. Petitioners claim that praying to release the plots, representation was submitted to Visakhapatnam Urban Development Authority, on 26.10.2016, but the same is not acted upon so far.

When the matter is taken up, learned counsels appearing for the respective parties agreed for disposal of the writ petition with a direction to the 2nd respondent to consider the representation of the 1st petitioner.

Writ petition is accordingly disposed of directing the 2nd respondent to consider the representation submitted by 1st petitioner on 26.10.2016 and pass appropriate orders as warranted by law by assigning due reasons and communicate the decision to the petitioners within a period of six weeks from the date of receipt of copy of this order.
