THE HON'BLE SRI JUSTI CE SANJAY KUMAR CONTEMPT CASE No.113 of 2015 ORDER:

This contempt case was instituted alleging wilful disobedience to the order dated 10.07.2012 passed by this Court in W.P.No.11197 of 2012. By the said order, this Court set aside the order of suspension issued against the petitioner and directed the Andhra Pradesh State Road Transport Corporation (APSRTC) to reinstate him in service forthwith with all consequential benefits. Liberty was however given to the APSRTC to proceed with the enquiry against him and take an appropriate decision. This Court is informed that the disciplinary proceedings which were pending against the petitioner ended in imposition of a minor penalty. While so, Sri S.V.Ramana, learned counsel for the respondents, produced proceedings dated 14.11.

2018 of the Regional Manager, APSRTC, Visakhapatnam, stating to the effect that the period of suspension undergone by the petitioner shall be treated as 'on duty' and that he would be entitled to drawal of annual increments as usual. Sri G.V.Shivaji, learned counsel for the petitioner, would point out that the aforestated order needs to be given effect to by making actual payments.

Sri S.V.Ramana, learned counsel, would report to this Court that payments would be made in the next month.

Recording the said statement, the contempt case is closed. In the event the respondent fails to make payments in terms of the said statement, it would be open to the petitioner to initiate contempt proceedings afresh. No order as to costs.
