Heard the counsel for petitioner the learned Government Pleader for Civil Supplies (Telanagana) and the learned Government Pleader for Home (Telangana) for respondents.
2. The petitioner's vehicle, a goods carriage bearing No.AP 16 TU 0989 was seized in connection with FIR.No.434 of 2015 dt.09.10.2015 on the file of 6th respondent on allegation that it was involved in transport of PDS Rice illegally.
3. The petitioner contends that he had no knowledge of this fact and that the vehicle be released to him since it would otherwise get damaged if it is left in the custody of 6th respondent.
4. The learned Government Pleader for Civil Supplies (Telangana) appearing for respondents, states that subject to petitioner furnishing a bank guarantee to the value of the vehicle as assessed by the Motor Vehicle Inspector, Khammam, the respondents be directed to release the vehicle and also subject to the petitioner producing the vehicle as and when required by respondents, and that the petitioner shall not alienate the same.
5. Having regard to the said submission, the Writ Petition is disposed of directing 6th respondent to release the goods carriage of petitioner on condition of petitioner furnishing a bank guarantee for the value of vehicle as assessed by the Motor Vehicle Inspector, Khammam, and on giving an undertaking that
petitioner will not alienate the said vehicle and shall produce the same as and when required by 6th respondent. No order as to costs.
6. As a sequel, miscellaneous petitions pending, if any, in this Writ Petition shall stand closed.
