THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE GUDI SEVA SHYAM PRASAD WRI T PETI TI ON No.1054 of 2016 ORDER: (per SK,J) This writ petition was filed to set aside the sale notice dated 16.12.2015, whereunder the auction was scheduled to be held on 19.01.2016.

Sri A.Krishnam Raju, learned counsel for the State Bank of Hyderabad, the respondent, states that the sale which took place on 19.01.2016 came to naught as the sale consideration was subsequently refunded to the successful bidder. In effect, the sale proposed under the notice dated 16.12.2015 did not materialise.

Sri T.Vijay Kumar, learned counsel representing Sri Mukesh Sharma, learned counsel for the petitioner, does not dispute the aforestated facts.

The writ petition is accordingly dismissed as no adjudication is warranted on the sale notice dated 16.12.2015 which came to naught. All issues are left open.

Interim order dated 18.01.2016 shall stand vacated. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
