HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.2988 OF 2015 ORDER:

Challenging the action of the respondents in trying to dispossess the petitioner, this writ petition is filed.

When the matter has come up for hearing, learned counsel for the petitioner seeks permission of this Court to withdraw the writ petition. Learned Assistant Government Pleader for Revenue, on instructions as made available by the Deputy Collector and Tahsildar on 13.12.2015, submits that the petitioner had placed before the Court a certificate alleged to have been issued by the Mandal Revenue Officer/Tahsildar to the effect that one Smt Joggu Jangamma, W/o. Balaiah was given the land over an extent of 333.33 sq. yards or 278.70 sq. meters in Sy.No.40 of the Khajaguda village. He further submits that on verification of the revenue record, it reveals that the said certificate is a fabricated one and the petitioner shall be put to strict proof of the genuineness of the same. Inasmuch as no orders in favour of the petitioner are being passed on account of the writ petition is being withdrawn, leaving it open to the respondents to initiate appropriate proceedings against the beneficiary and fabricator of the alleged document.

Accordingly, the writ petition is dismissed as withdrawn. No order as to costs.

Miscellaneous petitions, if any pending in this writ petition, shall stand closed.
