HON'BLE SRI JUSTICE T. AMARNATH GOUD WRIT PETITION No.9943 of 2019 ORDER :
This writ petition is filed seeking Mandamus declaring the action of respondent No.2 in not releasing power supply to the petitioner's house bearing No.13-3-608/12, Puranapul, Hyderabad, pursuant to his application dt.29.01.2019, inspite of payment of necessary fee and charges, as arbitrary, illegal and contrary to Section 43 of the Electricity Act, 2003. The grievance of the petitioner is that respondent No.2, having received application dt.29.01.2019 submitted by the petitioner, is not releasing the power supply to his house. Learned counsel for the petitioner submits that respondent No.4, claiming himself as owner of the subject house, is not allowing the Electricity officials to install the Electricity Meter in the said premises.
Heard learned counsel for the petitioner and Sri R. Vinod Reddy, learned Standing Counsel for respondent Nos.1 to 3 - Telangana State Southern Power Distribution Company Limited.
Having heard learned counsel for the respective parties, this Court is of the considered view that without going into the merits of the case, it is just and proper to dispose of the writ petition directing respondent No.2 to consider the application
TA, J W.P.No.9943 of 2019 dt.29.01.2019 submitted by the petitioner for providing power supply and pass appropriate orders in accordance with the Electricity Act, 2003 and the Rules made thereunder, as expeditiously as possible, preferably within a period of two (2) weeks from today, after calling for objections, if any, from respondent No.4.
With the above direction, this writ petition is disposed of. No order as to costs.
As a sequel, miscellaneous petitions pending, if any, in this writ petition shall stand closed.
