HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No. 10086 OF 2019 O R D E R :

This writ petition is filed challenging the action of the respondents 6 and 7 in putting the petitioner's car Honda Verna bearing No. AP 22 AR 1269 in their illegal custody, by damaging the entire car, without registering any crime, inspite of the petitioner's representation dt.27.04.2019.

Heard learned counsel for the petitioner.

Learned Assistant Government Pleader for Home produced written instructions dated 08.05.2019 furnished by the Sub Inspector of Police, Burgampahad P.S., Bhadradri, Kothagudem District, wherein it is stated that the said vehicle is subject matter of Crime No.94/2019, registered under Section 337 IPC on the file of Burgampahad Police Station on 20.04.2019; that during the course of investigation, the said car was seized on 23.04.2019 and produced before the Judicial Magistrate of First Class, Bhadrachalam, vide Form 60, dt.30.04.2019 and is in the custody of the said Court.

In view of the aforesaid instructions, by placing on record the written instructions submitted by the learned Assistant Government Pleader, the writ petition is disposed of granting liberty to the

petitioner to approach the concerned Court for release of the vehicle. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
