O R D E R

This Criminal Petition is filed under Sections 480 & 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioners/Accused Nos.3 to 7 seeking to enlarge them on bail in connection with Crime No.19 of 2026 of Dudyal Police Station, Vikarabad District, registered for the offences punishable under Sections 109, 118 (1) and 352 read with 3 (5) of the BNS 2.

The case of the prosecution is that on 28.02.2026 at 20:50 hours the de facto complainant came to the police

- 2 - station and lodged a complainant, wherein it is stated that on the same day at 16:00 hours when her mother and father were picking the tamarind fruits from the tree, meanwhile, her elder father came and beat her father with a stick by keeping the previous land disputes between their two families. Due to which, her father sustained blunt injuries on his back. Thereafter, her elder father and his grandson both beat her mother with sticks, due to which she also got a blood injury on her right hand and multiple blunt injuries on her body. When the complainant questioned the accused persons in this regard, one Rathod Raju, came with an exe and hit on her back head, as a result, she got blood injury and later all the accused persons abused the complainant and her family in filthy language. Hence, she requested the police to take necessary action on the said complaint. Basing on the same, police registered a case for the aforesaid offences. 3.

Heard Sri R.Prasanth, learned counsel for the petitioners/A.3 to A.7 and Sri M.Ramachandra Reddy, learned Additional Public Prosecutor, appearing for the respondent-State.

The contention of learned counsel for the petitioners/accused Nos.3 to 7 is that though there are no specific allegations against these petitioners, they were falsely implicated in this case; that as material part of the investigation is completed, custodial interrogation of the petitioners is not required in this case; that the petitioners were remanded to judicial custody on 23.03.2026 and since then they are in jail and hence, he requested the Court to grant regular bail to the petitioners.

On the other hand, learned Additional Public Prosecutor opposed the same and submits that the offences alleged against the petitioners are heinous and grievous in nature and that investigation is not yet completed and hence, at this stage, the petitioners are not entitled for grant of bail and hence, he prays to dismiss the petition.

Considering the submissions made by learned counsel for both parties and perusal of the material on record, the petitioners have been in judicial custody from 23.03.2026 and considering that the fact that the accused attacked the complainant's family with an axe and sticks due to previous

- 4 - disputes only, this Court deems it fit to grant regular bail to the petitioners/A.3 to A.7 subject to the following conditions: (i) The petitioners-A.3 to A7 shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties for a like sum each to the satisfaction of the learned Judicial Magistrate of First Class, Kodangal, Vikarabad District.

(ii) On such release, the petitioners-A.3 to A.7 shall appear before the concerned SHO between 11:00 a.m. and 5:00 p.m., on every Monday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

(iii) The petitioners-A.3 to A.7 shall abide by the conditions stipulated in Section 437 (3) of Cr.P.C. (presently, Section 480 (3) of BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
