When the matter is called, Sri B. Parameswara Rao, learned counsel for the appellant, and Sri B. Devanand, learned Standing Counsel for the Insurance Company appearing for respondent No.3, submitted that the subject matter of this Civil Miscellaneous Appeal is squarely covered by the judgment of this Court in C.M.A.No.3350 of 2003, dated 13.06.2012, and hence in view of the said judgment, this appeal may be dismissed.

In view of the said submission and as the subject matter of this appeal is squarely covered by the aforesaid judgment, dated 13.06.2012, this appeal is also dismissed following the aforesaid judgment and for the reasons recorded therein.
