Puraji Venkatappa v. The State Of Andhra Pradesh
THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.8130 of 2018 ORDER:
The petitioner states that he is an ex-serviceman and he was assigned the land of an extent of Acs.4.00 in Survey No.125/2 of Palasamudram Village, Gorantla Mandal, Ananthapuramu District, by proceedings dated 25.06.2008. He has been in possession of the said land since the date of assignment. Pattadar pass books and title deeds were also issued in his favour. While so, he submitted applications on 23.11.2017 and 09.02.2018 for mutation of his name in the revenue records. When no action was taken, the present Writ Petition is filed.
This Court noticed that the petitioner did not follow the procedure prescribed under the provisions of the Andhra Pradesh Rights in Land and Pattadar Pass Books Act for his request to mutate his name in the revenue records. He has to file an application in the prescribed Proforma by paying requisite fee.
In view of the above, this Court is not inclined to entertain the present Writ Petition, but gives liberty to the petitioner to follow the provisions of the said enactment and make the application in accordance with law. As and when such application is filed, it is needless to observe that the fourth
respondent shall consider the same and pass appropriate orders in accordance with law.
The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 13.03.2018 vs
