CVNR,J & MSKJ,J WP.22621 of 2017 THE HON'BLE SRI JUSTI CE C.V.NAGARJUNA REDDY & THE HON'BLE SRI JUSTI CE M.S.K.JAI SWAL WRI T PETI TI ON No.22621 of 2017 ORDER: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) This writ petition is filed for issue of habeas corpus, directing the respondents to produce two persons, by name, (1) Naganuri Chinna, S/o.N.Raju, and (2) Naganuri Kumar, S/o.N.Raju (for short "the alleged detenus Nos.1 & 2 respectively") before the Court and set them at liberty. Respondent No.3 filed counter affidavit, wherein he has inter alia averred that the alleged detenu No.1 is accused in Cr.No.26 of 2017 for the offence under Section 379 IPC of Yerravaripalem Police Station, Piler Rural Circle, Chittoor District, that the police have arrested him on 14.07.

2017 and produced him before the Judicial First Class Magistrate, Piler on 15.07.2017, and that the said alleged detenu No.1 was remanded to judicial custody, and in pursuance of which, he has been lodged in Sub-Jail, Piler from 15.07.2017 onwards. As regards the alleged detenu No.2, the police have denied his arrest. At the hearing, Mr.V.Nitesh, learned counsel for the petitioner, did not dispute the contents of the counter affidavit, referred to above.
