HONOURABLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.4127 of 2017 ORDER:

In this petition filed under Sections 437 and 439 Cr.P.C., Petitioner/A2 seeks regular bail in Cr.No.201 of 2016 of Tuni Rural Police Station, which was registered for the offence under Section 8 (c) read with 20 (b) (ii) (c) of NDPS Act, 1985 against the petitioner/A2 and three others.

The prosecution case is that on 31-10-2016 at 1 P.M., on receipt of reliable information about the illegal transportation of Ganja, Inspector of Police Tuni, having obtained orders from the Sub-Divisional Police Officer, Peddapuram to conduct vehicle check, conducted vehicle checks along with staff and mediators and during the course of such check, he noticed accused No.1 to 4 transporting 40 Kgs. of Ganja by Maruthi Suzuki Car EECO Car bearing No.AP 31 DE 5803 and seized the contraband and arrested the accused.

Admittedly, charge sheet was filed in this case. However, considering the fact that commercial quantity of Ganja was seized from the possession of accused and the matter is in the stage of numbering the Sessions Case and framing of charges, after appearance of the accused, it is not a fit case to grant bail to the petitioner/A2 at this stage. He can renew his bail application after charges are framed. Accordingly, this Criminal Petition is dismissed. As a sequel, miscellaneous applications pending if any, shall stand closed.
