THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.10185 OF 2016 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue appearing for the respondents.

2. This Writ Petition is filed questioning the order dt.26.03.2016 passed by the 3rd respondent in exercise of the power under Section 6 of the Land Encroachment Act, 1905.

3. Counsel for the petitioner states that though there is a remedy of appeal against the impugned order, in view of the threat of dispossession by the respondents, this Writ Petition is filed and he seeks permission of the court to file appeal.

4. In view of the said submission, this Writ Petition is disposed of directing the petitioner to avail the remedy of appeal against the impugned order along with stay application within a period of eight

(08) weeks from today. If such an appeal along with stay application being presented by the petitioner, the same shall be disposed of by the 2nd respondent in accordance with law. In view of the threat expressed by the petitioner, there shall be stay of operation of the impugned order dt.26.03.2016 for a period of eight (08) weeks from today. There shall be no order as to costs.

5. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
