HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 25223 of 2003 ORDER:

This writ petition is filed seeking to issue a writ of certiorari calling for the records relating to and connected with M.P.No.75 of 2000 on the file of the 2nd respondent-Labour Court and quash the order dated 02.12.2002 passed therein holding it as illegal and arbitrary.

Learned standing counsel for the petitioner corporation has contended that the Labour Court ought not to have allowed the claim made by the respondent workman by way of a single line order and the Labour Court has passed the order in a very perfunctory manner without giving any reasons and, therefore, the impugned order is liable to be quashed.

While admitting the writ petition, this Court granted interim suspension of the impugned order subject to the condition that the petitioner deposits half of the amount awarded by the authority below within six weeks and the respondent workman is at liberty to withdraw the amount deposited without furnishing any security, vide order dated 03.12.2003 in WPMP No.31780 of 2003. In view of the above and in order to give quietus to the litigation, the writ petition is dismissed.
