HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 24081 of 2003 ORDER:

This writ petition is filed seeking to issue a writ of certiorari calling for the record relating to and connected with I.D.No.227 of 1998 on the file of the 2nd respondent-Labour Court and quash the award dated 30.08.2001, whereby the Labour Court directed reinstatement of the petitioner with continuity of service while setting aside the orders of removal of the petitioner from service and denying back wages, holding it as illegal and arbitrary. None appeared for the petitioner.

This Court, having gone through the entire record, is of the considered view that the Labour Court has rightly passed the award in favour of the petitioner and no illegality or irregularity is noticed in the award passed by the Labour Court. In the absence of the same. this Court cannot interfere with the award of the Labour Court, more so, when the Labour Court had exercised its power under Section 11A of the Industrial Disputes Act. I find no merits in the writ petition and the same is liable to be dismissed.

Accordingly, the writ petition is dismissed. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed. No order as to costs.
