ORDER:

The grievance of the petitioners is that the officials of the Greater Hyderabad Municipal Corporation have removed the tree growth over open space and have raised a compound wall for the purpose of raising constructions contrary to the approved layout. At the hearing, Mr. P.Kesava Rao, learned Standing Counsel for the Greater Hyderabad Municipal Corporation, submitted that during the Swach Bharath programme, a vacant site was identified and that, under a mistaken impression that the same is available for constructing the buildings for library and Municipal Ward Office, it was made ready for such constructions, by issuing proceedings, dated 03.10.2015; and that, later, it was realised that the said site is a part of the public road situated at the dead end of the street. He has further submitted that upon realisation of this fact, the Corporation is proposing to cancel proceedings, dated 03.10.2015, and drop all further steps for construction of the buildings in the said vacant site.

In the light of the above submissions of the learned Standing Counsel, the Writ Petition is disposed of with the direction to respondent Nos.2 to 4 to remove the compound wall raised by them within two weeks from the date of receipt of a copy of this order.

As a sequel to disposal of the Writ Petition, W.P.M.P.No.48299 of 2015 shall stand disposed of as infructuous. ____________________________ JUSTICE C.V.NAGARJUNA REDDY 18th November, 2015 DR
