The present Criminal Petition is filed by the petitioner under Section 438 Cr.P.C. seeking release in the event of his arrest in connection with Crime No.64 of 2014 of Thamballapalle Police Station, Chittoor District, registered for the offences punishable under Sections 379, 427 IPC and Section 136 (1) (a) of the Indian Electricity Act.

At the time when the matter is taken up for hearing, the learned Public Prosecutor on instructions submitted that the petitioner is not an accused in the said crime. In view of the representation made by the learned Public Prosecutor that the petitioner is not an accused in the above Crime, nothing survives in the petition and the same is accordingly closed. _____________________ C.
