HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.3380 of 2018 ORDER:

This Criminal Petition is filed by the petitioner/A1 under Section 482 Cr.P.C., praying the Court to exercise its plenary power under Section 482 Cr.P.C and direct the trial Court to dispose of S.C.No. 233 of 2017 expeditiously.

Heard learned counsel for petitioner. His submission is that the trial Court in Crl.M.P.No. 47 of 2017 in Crl.M.P.No. 502 of 2017 in S.C.No. 233 of 2017 dated 22.9.2017 permitted the petitioner/A1 to leave India on 30.09.2017 and return back to India on 16.4.2018 and if the sessions case is disposed of early, he can visit USA in pursuance of his job and therefore, a direction may be given to the trial Court for early disposal of the case.

It is seen that Sessions Case No. 233 is of the year 2017, which is relatively a new case. In that view of the matter, this Court cannot give any direction to the trial Court to dispose of the said case immediately in preference to the other old matters pending before the said Court. However, considering the prayer of the petitioner, the trial Court is directed to consider the request of the petitioner and try to dispose of the Sessions Case No. 233 of 2017 at the earliest not later than six months after receipt of a copy of this order.

UDPR, J CRP NO. 3380 OF 2018 Accordingly, the Criminal Petition is disposed of. As a sequel there to, miscellaneous applications, pending if any, shall stand closed. _________________________ U.DURGA PRASAD RAO, J Date: 19.03.2018 KA
