THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.36597 of 2015 ORDER:
The grievance of the petitioner was that the Inspector of Police, Udayagiri Circle, SPSR Nellore District, and the Sub-Inspector of Police, Duthaluru Police Station, Udayagiri, SPSR Nellore District, respondents 4 and 5, were interfering with his peaceful possession and enjoyment over the property which was the subject matter of O.S.No.207 of 2015 on the file of the District Court, Nellore. The subject land was stated to admeasure Ac.80.00 cents and allegedly belongs to the petitioner and his mother. The petitioner alleged that though the land was in a civil dispute and the matter was subjudice before the competent civil court, the police authorities were interfering.
Written instructions dated 03.12.2015 were furnished by the Sub-Inspector of Police, Duthaluru Police Station, SPSR Nellore District, to the office of the learned Government Pleader for Home, wherein he stated that the petitioner never approached the police authorities or filed a complaint but on the other hand, he got issued a legal notice which was received on 10.10.2015, alleging that the police were interfering in civil disputes. The Sub-Inspector further stated that the police authorities never interfered in the petitioner's civil disputes and as the matter was subjudice, the police would not interfere in the matter. The allegations to the contrary made by the petitioner were denied. The afore-stated stand of the police authorities is duly taken on record. In the light thereof, no adjudication is warranted on merits in this writ petition, which is accordingly closed.
Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
