HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION NO. 42352 OF 2016 ORDER:

Petitioner alleges that even though valid building permission was granted by the Grampanchayat on 5.8.2016 for construction of ground plus two upper floors, while the petitioner undertaking construction, the authorities of the respondents are obstructing the construction activity and preventing the petitioner from undertaking the construction without any justifiable cause or reason.

Learned Standing Counsel appearing for Grampanchayat submits that Grampanchayat is not interfering with the construction activity of the petitioner.

Having regard to this submission, the Writ Petition is disposed of directing the respondents 2 & 3 not to interfere with the construction activity of the petitioner as long as petitioner undertakes construction of building in accordance with the building permission granted to him on 5.8.2016 and the said permission is valid and in force. However, if there is any deviation or any additional construction is made, it is open to the respondent authorities to prevent the petitioner from undertaking such construction or to take further course of action as prescribed under law. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, pending if any, shall stand closed. ______________________ P. NAVEEN RAO, J Date: 07.12.2016 KA
