THE HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION NO.394 OF 2012 ORDER:
Heard the learned counsel for the petitioner and the learned Government Pleader for Home appearing for respondents 1 and 2.
The prayer sought in the writ petition reads as under: "...............Writ, Order or Direction more particularly one in the nature of Mandamus declaring the action of the 1st Respondent in issuing a notice dt.31.12.2011 bearing Crime No.255/WZ-2T/CCS/2011 to the petitioner demanding the petitioner to produce and deliver the original documents mentioned in the said notice, as illegal, high handed, arbitrary and against to the Provisions of the SARFAESI Act, 2002 and to set aside the same."
During the course of arguments, it is brought to the notice of this Court that the matter was referred to Lok Adalath and the defacto complainant appeared before Mega Lok Adalath in the Criminal Court Complex and filed a petition dated 09.09.2017 for compromise and accordingly, the case was compromised vide order dated 09.09.2017 in Crl.MP.No.4120/2017.
The Assistant Commissioner of Police addressed a letter dated 09.09.2017 to the office of the learned Government Pleader for Home of this Court mentioning the facts and also a copy of the Award passed by the Lok Adalath.
In the light of the above facts, this Court is of the opinion that no further cause would survive in the writ petition.
Accordingly, the writ petition is dismissed. No order as to costs.
Pending miscellaneous petitions, if any, shall also stand dismissed.
