O R D E R

The grievance of the petitioner is as to the inaction on the part of the police authorities in conducting an investigation pursuant to the complaint in CCSR No.9212 of 2012 referred by the IX Metropolitan Magistrate, Cyberabad at Kukatpally, under Section 156 (3) Cr.P.C. A copy of the official memorandum addressed by the Court to the Station House Officer, Kukatpally, in this regard is

placed on record at page 26 of the material papers. Learned Government Pleader for Home fairly conceded before this Court that the Court below did in fact pass orders under Section 156(3) Cr.P.C., but as the file was misplaced, the police authorities were handicapped. Sri Ambadipudi Satyanarayana, learned counsel for the petitioner, stated that all the requisite papers would be supplied to the police authorities, so that they could reconstruct their file for the purpose of giving effect to the order passed by the learned IX Metropolitan Magistrate, Cyberabad at Kukatpally, in exercise of powers under Section 156(3) Cr.P.C. He further states that some of the documents have already been furnished.

In the light of the aforestated facts, the writ petition is disposed of permitting the petitioner to supply all the necessary material to the Station House Officer, Kukatpally Police Station, Ranga Reddy District, so that the order passed by the learned IX Metropolitan Magistrate, Cyberabad at Kukatpally, under Section 156 (3) Cr.P.C. in CCSR No.9212 of 2012 can be given effect to. The police authorities shall take all possible steps to complete the investigation in the crime once it is registered, as expeditiously as possible, keeping in kind the delay that ensued owing to their lapse in misplacing the papers. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs. ______________________ SANJAY KUMAR, J 24th NOVEMBER, 2015 PGS
