HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CIVIL MISCELLANEOUS PETITION No.657 of 2015 ORDER:
This petition is filed to withdraw F.C.O.P.No.3 of 2015 from the file of Family Court-cum-Additional District Judge at Guntur and transfer the same to Judge, Family, Court, Vijayawada.
2. Wife filed this petition. According to her affidavit, she was necked out from the matrimonial home on 26.09.2012 and now she is residing on the mercy of her father. She stated that her father is already burdened with two other unmarried daughters and she is finding difficult to travel from Vijayawada to Guntur as she has no financial support. She stated that she filed maintenance case before Family Court, Vijayawada and the respondent is already attending the said Court and that no prejudice will be caused to him if O.P. is transferred from Guntur to Vijayawada.
3. Respondent has not filed any counter disputing the affidavit averments of the petitioner.
4. Heard both sides. Perused the affidavit filed in support of the petition.
5. Advocate for petitioner submitted that the petitioner is living on the mercy of her father and she has no financial support, hence, sought for transfer of O.P from Guntur to Vijayawada as she is finding it difficult to meet the travel expenses.
6. On the other hand, advocate for respondent submitted that the distance between Guntur and Vijayawada is hardly 50kms and the request of the wife is not genuine.
7. Considering the submissions of both parties and also considering the convenience of the wife, I am of the view that O.P.No.3 of 2015 is withdrawn from the file of Family Court-cumAdditional District Judge at Guntur and transferred to Family, Court, Vijayawada, for disposal in accordance with law.
