HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.19056 OF 2015 ORDER:
The grievance of the petitioners is that they were granted interest at the rate of 9% from the date of making application filed under Section 28 (A) of Land Acquisition Act, though they are entitled interest from the date of notification. Aggrieved by the same, the present writ petition is filed. Heard learned counsel for the petitioners, who relied on judgment dated 2107-2008 of this Court in WP.No.2183 of 2008. The said judgment is carried on Appeal and disposed of by Division Bench of this Court in W.A.Nos.1765 and 1785 of 2008 on 12-02-2009. The same was confirmed by the Supreme Court in SLP.No.13755 of 2009 dated 21-08-2009. The same is not disputed by learned Assistant Government Pleader for Land Acquisition. It is also stated by learned counsel for the petitioner that in similar circumstances, this Court disposed of WP.No.
25873 of 2012 dated 22-08-2012 by following the judgment of Apex Court and this Court in WP.No.25791 of 2011, dated 15-09-2011. Following the same, the writ petition is disposed of holding that the petitioners are entitled for interest from the date of notification under Section 4 (1) of the Act, instead of date of their applications filed under Section 28-A of the Act. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
