ORDER

This Criminal Petition is filed praying this Court to enlarge the petitioner on bail who is arrayed as accused No.1 in Crime No.175 of 2025 before the Bollarum Police Station,

Hyderabad, registered for the offence punishable under Sections 8(c) read with 20(b), 22(c), 27(A) and 29 of NDPS Act. 2.

The brief facts of the case are that on 30.10.2025, based on credible information, the police of Bollarum Police Station intercepted a Hyundai Verna car near Bollarum Check Post and found two persons travelling in the vehicle. On search, the police allegedly recovered 100 grams of Ganja, 12 LSD blots, 20 grams of MDMA and 2 grams of Cocaine, along with OCB papers and other articles. The accused persons allegedly confessed that they had procured the contraband substances from Bengaluru for the purpose of selling them in Hyderabad. Basing on the above complaint, the crime was registered for the above said offences.

Heard Sri K. Joseph Bala Prathap, learned counsel appearing on behalf of the petitioner as well as Sri M. Ramachandra Reddy, learned Additional Public Prosecutor appearing on behalf of the respondent - State. 4.

Learned counsel for the petitioner submitted that the petitioner is innocent and has been falsely implicated in the case and that no contraband substance was recovered from

his conscious possession and that the petitioner was merely present in the vehicle and mere presence does not constitute possession or conspiracy under the NDPS Act. He further submitted that the mandatory provisions under Sections 42 and 50 of the NDPS Act have not been properly complied with by the police and that the alleged confession given to the police is inadmissible in evidence. Therefore, he prayed the Court to grant bail to the petitioner by allowing this Criminal Petition.

On the other hand, learned Additional Public Prosecutor opposed the bail petition and submitted that the petitioner is involved in a serious offence relating to possession and transportation of narcotic drugs and that contraband substances were seized from the vehicle in which the petitioner was travelling. He further submitted that the investigation has revealed the involvement of the petitioner along with other accused in procuring and supplying narcotic substances and the case attracts the provisions of the NDPS Act, which are stringent in nature. At this stage, granting of bail to the petitioner does not arise. Therefore, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and a perusal of the material available on record, it appears that the petitioner is in jail since 30.10.2025. As seen from the record, the material part of the investigation has been completed and L.Ws.1 to 12 witnesses have already been examined. Considering the facts and circumstances of the case and the incarceration period of the petitioner, this Court deems it fit to grant bail to the petitioner, subject to the following conditions: i.

The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the XXII Additional Chief Judicial Magistrate, Secunderabad.

ii.

The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of

investigation, and thereafter, as and when required.

iii.

The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.(presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
