THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 17519 of 2016 ORDER :

This Writ Petition is filed seeking to declare the action of respondent Nos.4 and 5 in interfering with civil dispute between the petitioner and respondent No.6 pertaining to land admeasuring Ac.1.00 situated in survey No.940 of Kondaveedu village, Narasaraopet Mandal, Guntur District, as illegal and arbitrary.

2. Heard the learned counsel for the petitioner and the Assistant Government Pleader for Home for the State of Andhra Pradesh appearing for respondents 1 to 5. At the request of both the counsel, the Writ Petition itself is taken up for disposal at the stage of admission.

3. The case of the petitioner is that there exists a civil dispute between him and respondent No.6 in respect of land situated in survey No.940, which is the subject matter of dispute in Original Suit No.45 of 2016 on the file of the Junior Civil Judge, Chilakaluripeta filed by respondent No.6 against the petitioner and others. It is averred that at the instance of respondent No.6, respondents 4 and 5 are interfering with the civil dispute and facilitates respondent No.6 to lay a fence around the land. Learned Assistant Government Pleader appearing for respondents 1 to 5, on instructions, states that respondent Nos. 4 and 5 are not

interfering with the civil dispute between petitioner and respondent No.6 and they are only discharging their duties as per law. Recording the said submission, the Writ Petition is disposed of making it clear that any interference by respondent No.6 shall be in accordance with law.

4. Miscellaneous petitions pending, if any, in the Writ Petition shall stand closed in the light of this final order. No order as to costs.
