THE HON'BLE SRI JUSTICE A.ABHISHEK REDDY WRIT PETITION No.11590 of 2021 ORDER:

Heard the learned counsel for the petitioners, the learned Government Pleader for Municipal Administration and Urban Development for respondent No.1, and Sri N.Praveen Kumar, the learned Standing Counsel for respondent No.2. With their consent, the Writ Petition is disposed of at the stage of admission. Aggrieved by the action of the respondents in revoking the building permission granted in favour of the petitioner in respect of the subject plot, the present writ petition is filed. As seen from the impugned order, dated 25.03.2021, passed by respondent No.2, the building permission granted earlier in favour the petitioner in respect of the subject plot was revoked by the respondent No.2 on the ground that W.P.No.22218 of 2020 is pending before this Court.

Learned Standing Counsel, on instructions, has stated that if the petitioner submits any representation complying the objections raised in the impugned revocation order, dated 25.03.2021, the authorities will consider the same and pass necessary orders thereon, in accordance with law. Having regard to the submission made by the learned Standing Counsel, without going into the merits or demerits of the case, the petitioner is directed to submit a representation before the respondent authorities, reporting compliance to the objections raised by the authorities in the impugned order, dated 25.03.2021, within a period of one week from the date of receipt of a copy of

this order. On such representation being received, the respondent authorities shall consider the same and pass necessary orders thereon, strictly in accordance with law, as expeditiously as possible, preferably, within a period of four weeks thereof. Till such time the orders are passed by respondent No.2, the petitioner also shall not undertake any construction activity. Accordingly, the Writ Petition is disposed of and the impugned order dated 25.03.2021 is set aside and the matter is remanded back to respondent No.2, with the above observations.
