G.Vailetamma v. The State Of Andhra Pradesh
THE HON'BLE SRI JUSTI CE C. PRAVEEN KUMAR WRI T PETI TI ON No.61 OF 2016 ORDER:
Heard the learned counsel for the petitioner and the learned Government Pleader for Revenue appearing for the respondents. With their consent, the present writ petition is disposed of at the admission stage.
2.
The present writ petition came to be filed with the following prayer:
"to issue a Writ order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the inaction of the Respondents 2 to 4 in failing to consider the petitioner's representation for grant of pattadar pass books dated 21-12-2015 concerning Ac. 2-00 cents in Sy.No. 284/14 and 285/4 situated at Kurakalava village of Renigunta Mandal, Chittoor District is illegal, arbitrary and unconstitutional and consequently direct the respondents to consider the representation of the petitioner dated 21-12-2015 without taking any coercive steps to dispossess the petitioner from the above said lands."
3.
Though various grounds are raised, learned counsel for the petitioner restricts his prayer seeking a direction to the 2nd respondent - District Collector, Chittoor District, to consider the representation dated 21.12.2015 made by the petitioner for issuance of pattadar pass books.
CPK,J WP_61_2016 4.
Learned Government Pleader, on instructions, submits that though the representation of the petitioner is for issuance of pattas, the present writ petition came to be filed for issuance of pattadar pass books, which is contrary to the request made in the representation. He further submits that the representation dated 21.12.2015 made by the petitioner was considered by the 2nd respondent and orders were passed on 31.12.2015 stating that the lands were already alienated in favour of Airport Authority of India on 18.07.2014. 5.
Though the learned counsel for the petitioner submits that no such an order was communicated to the petitioner, learned Government Pleader submits that an endorsement was made to that effect.
6.
In view of the representation made by the learned Government Pleader, cause in this writ petition would not survive for adjudication. Accordingly, the Writ Petition is dismissed as infructuous. However, the 2nd respondent - District Collector, who is said to have passed an order, shall communicate a copy of the order to the petitioner by Registered Post with acknowledgement due, at the earliest. Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs. _______________________ JUSTI CE C.
