THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE N. BALAYOGI WRI T PETI TI ON No.15047 of 2017 ORDER: (Per Justice Sanjay Kumar) The petitioner is the first applicant in O.A.No.356 of 2017 on the file of the Andhra Pradesh Administrative Tribunal, Hyderabad. By order dated 07.03.2017, the Tribunal dismissed the O.A. being of the opinion that the matter was squarely covered by its earlier order dated 15.06.2015 passed in O.A.No.1952 of 2015 and batch. Sri P. Narasimha, learned counsel for the petitioner, would state that the matter is squarely covered by the decision of this Court in W.P.No.11094 of 2017 and batch. A copy of the common order dated 06.04.2017 passed in W.P.No.11094 of 2017 and batch is placed on record.

Ms. Kamla Seelam B., learned counsel representing Sri C.Srinivasa Baba, learned counsel for the Andhra Pradesh Public Service Commission, fairly concedes so.

In that view of the matter, for reasons alike as were stated in the aforestated common order and in terms thereof, the order passed by the Tribunal in O.A.No.356 of 2017 in so far as it pertains to the petitioner herein is set aside and the O.A. is remitted to the Tribunal for consideration afresh of his case on facts and in accordance with law. The Tribunal shall endeavour to dispose of the O.A. along with O.A.Nos.605, 606 and 607 of 2017, which were earlier remitted for consideration afresh under the aforestated common order. Pending this exercise, as the interest of the petitioner would be at risk, there shall be a direction to the

authorities to keep one post of Deputy Tahsildar in Zone-III unfilled till the adjudication of the O.A. afresh.
