ORDER

This Criminal Petition is filed praying this Court to enlarge the petitioner on bail who is arrayed as accused No.2 in Crime No.88 of 2025 before the Jagtial Rural Police Station, Jagtial District, registered for the offence punishable under

Sections 318(4), 308(5), 127(2), 351(2), 143 read with 61(2) of BNS and Section 66D of IT Act and Section 24 of Emigration Act.

The brief facts of the case are that on 04.03.2025, a complaint was lodged at Jagtial Rural Police Station alleging that the complainant was lured with a promise of a call center job in Thailand, taken abroad, and forced to engage in fraudulent activities. It is alleged that the accused persons collected money from the complainant, confiscated his passport, and compelled him to participate in cyber fraud. After managing to return to India, the complainant reported the matter and the same was registered for the above said offences.

Heard Sri Gonepatla Ajay, learned counsel appearing on behalf of the petitioner as well as Sri M. Ramachander Reddy, learned Additional Public Prosecutor appearing on behalf of the respondent - State 4.

Learned counsel for the petitioner submitted that the petitioner is innocent and has been falsely implicated, with no direct role in the alleged offence and that the petitioner was

merely acquainted with the main accused and no overt act is attributed to him in collecting money, transporting victims, or confining them. There is no material to show that he received any financial benefit or had knowledge of the alleged illegal activities. His implication is based solely on inadmissible confessional statements of co-accused. He contended that the investigation is substantially completed and the custodial interrogation is not required. Therefore, he prayed the Court to grant bail to the petitioner by allowing this Criminal Petition.

On the other hand, learned Public Prosecutor submitted that the petitioner is involved in the commission of serious offences including cheating, human trafficking, and cyber fraud, and his role has emerged during the course of investigation. He contended that the petitioner facilitated the main accused by introducing victims, thereby playing a crucial role in the offence. At this stage, granting of bail to the petitioner does not arise. Therefore, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and a perusal of the material available on

record, it appears that the petitioner is in jail since 20.02.2026. As seen from the record, the material part of the investigation has been completed and L.Ws.1 to 14 witnesses have been examined.

Considering the facts and circumstances of the case and the incarceration period of the petitioner, this Court deems it fit to grant bail to the petitioner, subject to the following conditions: i.

The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the Principal Junior Civil Judge-cumJudicial Magistrate of First Class, Jagtial.

ii.

The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of

investigation, and thereafter, as and when required.

iii.

The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.(presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
