HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 15213 of 2003 ORDER:

When the matter is taken up for hearing, it is brought to the notice of the Court that the petitioner has retired from service during pendency of the writ petition and, therefore, the question of reinstatement at this stage would not arise. Admittedly, the petitioner was removed from service vide orders dated 31.07.1995 issued by the 2nd respondent corporation. Challenging the same, he raised an industrial dispute in I.D.No.15 of 1998 on the file of the 1st respondent-Labour Court, Godavarikhani and the same was dismissed vide order dated 26.04.2001. In view of the above, the relief sought for by the petitioner cannot be granted. However, the petitioner is entitled for the benefits of service rendered by him prior to his removal from service.

Accordingly, the 2nd respondent corporation is directed to pay the service benefits of the petitioner prior to his removal from service, if not already paid, within a period of four (4) weeks from the date of receipt of a copy of this order. With the above direction, the writ petition is disposed of. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed. No order as to costs.
