ORDER

This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of prearrest bail to the petitioner, who are arrayed as accused in Crime No.54 of 2026 before the Madhapur Police Station, Hyderabad, registered for the offences punishable under Sections 316(5) and 318(4) of BNS.

The brief facts of the case are that, the de-facto complainant, lodged a report before the on 09.01.2026 stating that the

petitioner, who is working as Manager-Purchase at SRR Projects Pvt. Ltd., had accepted an illegal commission of Rs.75,000/- from a supplier, Mr. K. Raghava Reddy, Managing Director of V3 Automation, in connection with the supply of electrical items to the company. During an internal inquiry conducted on 07.01.2026, the petitioner admitted to the misconduct and submitted a written statement. Subsequently, upon further inquiry, the vendor, Raghava Reddy, also confirmed the facts and provided transaction details evidencing the commission payment. Hence, requested the police to take necessary action. Based on this report, the police registered a case against the accused for the above-mentioned offences.

Heard Sri Donkuri Mallikarjun, learned counsel appearing on behalf of the petitioner, and Sri E. Ganesh, learned Assistant Public Prosecutor appearing on behalf of the respondent-State. 4.

Learned counsel for the petitioner submitted that the petitioner is innocent of the allegations and has been falsely implicated in this case only with an intention to remove him from the company. He further submitted that there is no such amount misappropriated by the petitioner and that the complaint does not reveal any date of transactions credited and that the petitioner is ready and willing to cooperate with the investigation. Hence, he

prayed the Court to grant pre‐arrest bail to the petitioner by allowing the present Criminal Petition.

On the other hand, the learned Assistant Public Prosecutor opposed the submissions, contending that the allegations against the petitioner are serious in nature, that the investigation is at a nascent stage, and that custodial interrogation of the petitioner is necessary for effective investigation. Accordingly, he prayed for dismissal of the Criminal Petition.

In light of the submissions made by both learned counsel and upon perusal of the material available on record, it is evident that the allegation against the petitioner is that he accepted an illegal commission of Rs.75,000/- from the supplier, which was also admitted by the petitioner. Considering the allegation that he accepted the said commission amount and the nature of the accusation, this Court deems it fit to grant pre‐arrest bail to the petitioner, subject to the following conditions: i.

The petitioner shall surrender before the learned II Additional Junior Judge cum X Additional Judicial First Class Magistrate, Ranga Reddy District at Kukatpally within two weeks from today, and on such surrender, the said Court shall release him on bail on executing a personal bond for

Rs.25,000/- with two sureties, for the like sum each.

ii.

The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.

iii.

The petitioner shall appear before the concerned Investigating Officer on every Wednesday between 09:00 a.m, and 05:00 p.m. for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
