THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.36848 OF 2016 ORDER:
The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the respondents 1 to 4, more particularly, the fourth respondent in not providing police protection to the petitioner for protecting her showroom Nos.13, 14, 15, 16 and 17 in First Floor bearing Municipal No.22-7269/1/13, 14, 15, 16 and 17, in the light of her written complaint, dated 28.09.2016 and also not taking any action against the unofficial respondents 5 to 8 in connection with crime No.149 of 2016 as arbitrary and illegal, and consequently to direct the fourth respondent to provide police protection to the petitioner in respect of the subject property. Heard and perused the material.
Learned counsel for the petitioner submits that though the petitioner made a representation, dated 28.09.2016, for police protection to the property mentioned above, the fourth respondent is not providing any protection and is not acting upon her representation. He further submits that the fourth respondent is not taking any action against the respondents 5 to 8 though the crime being F.I.R.No.149 of 2016 is registered. Considering the facts and circumstances of the case, the writ petition is disposed of with a direction to the fourth respondent to dispose of the representation of the petitioner, dated 28.09.2016, in accordance with law. Insofar as the F.I.R.No.149 of 2016 is concerned, the fourth respondent is directed to complete investigation and file final report, if any, in accordance with law.
