THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN CIVIL REVISION PETITION No.1559 of 2015
ORDER:
Civil Revision Petition No.1559 of 2015 is filed against the order passed by the Principal Junior Civil Judge, Chodavaram in I.A. No.232 of 2013 in O.S. No.30 of 2010 dated 19.12.2014. I.A. No.232 of 2013 was filed by the petitioners herein under Order 22 Rule 3 to array them as the legal representatives of the plaintiff, and as plaintiffs 2 to 6 in the suit. The Court below dismissed the petition on the ground that it was filed 112 days after the death of the plaintiff. As the order of the Court below in I.A. No.233 of 2013, refusing to condone the delay, has been set aside by the order of this Court in C.R.P. No.1758 of 2015 dated 24.07.2015, the order impugned in the present Civil Revision Petition must also be set aside. I.A. No.232 of 2013 is restored to file. The Court below shall, with utmost expedition, decide I.A. No.232 of 2013 at the earliest and in accordance with law.
The Civil Revision Petition is disposed of accordingly. The miscellaneous petitions pending, if any, shall also stand disposed of. No costs.
