THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.3077 of 2018 ORDER:

This Criminal Petition, under Section 438 Cr.P.C., is filed to enlarge the petitioner/ A.1 on bail in the event of his arrest since he is apprehending arrest in connection with Crime No.38 of 2018 on the file of Godavarikhani I Town Police Station, registered for the offences under Sections 120(B) and 420 IPC and Sections 3 (5) (a) (b) of Money Lenders Act and Sections 4 and 5 of Price Chits Money Circulation Schemes ( Banning) Act, 1978.

After arguing the matter for awhile, learned counsel for the petitioner, requested this Court to direct the concerned to follow the procedure contemplated under Section 41-A Cr.P.C., and the guidelines issued by the Apex Court in Arnesh Kumar v. State of Bihar and another1 In view of the request made by the learned Counsel for the petitioner, the Police of Godavarikhani I Town Police Station, Peddapalli District, are directed to follow the procedure contemplated under Section 41-A Cr.P.C., and the guidelines laid down by the Supreme Court in Arnesh Kumar v. State of Bihar and another.

With the above direction, this Criminal Petition is disposed of. As a sequel, miscellaneous applications pending, if any, shall stand closed.
