HONOURABLE SRI JUSTICE ABHINAND KUMAR SHAVILI CRIMINAL PETITION No.2602 of 2019 ORDER:

The petitioners are accused Nos.2 and 3 in Crime No.159 of 2019 on the file of L.B.Nagar Police Station, Rachakonda, registered for the offences under Sections 304-B and 498-A. By way of this petition filed under Section 438 Cr.P.C., the petitioners seek grant of anticipatory bail.

It is contended by the petitioners that they are the parents of accused No.1 and that they have been falsely implicated in the above said crime. It has been alleged by the de facto complainant that they have demanded dowry and based upon the said allegations, the Police have registered a case. The petitioners further contended that they are no way responsible for suicide of their daughter-in-law.

Learned counsel for the petitioners submits that accused Nos.1 and 4 in the above crime were already granted regular bail by the Court below and that since the petitioners are aged persons, their cases may also be considered for grant of anticipatory bail. Learned Assistant Public Prosecutor contended that since the daughter-in-law of the petitioners committed suicide and the charge under Section 304-B IPC is levelled against the petitioners, this anticipatory bail application need not be considered and the same is liable to be dismissed.

Having considered the rival submissions of the parties and in view of the fact that accused Nos.1 and 4 were already granted

regular bail by the Court below, it is directed that the petitioners shall surrender before the learned III Additional District and Sessions Judge, L.B. Nagar, Ranga Reddy District, within ten days from the date of receipt of a copy of this order. Upon such surrender, the Court below shall consider the case of the petitioners for grant of anticipatory bail on the same day by duly taking into account that accused Nos.1 and 4 in the above crime were already granted regular bail.

With the above observations, the Criminal Petition is disposed of.
