THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.3080 of 2018 ORDER:

This criminal petition, under Sections 438 of the Code of Criminal Procedure, 1973 (for short 'Cr.P.C.'), is filed by the petitioner who is accused in Crime No.20 of 2018 of Rama Krishnapur, Ramagundam District registered for the offences punishable under Sections 417, 420 read with 34 IPC apprehending his arrest in connection with the above crime.

The counsel for the petitioner, after arguing the matter for a while, requests this Court to direct the Station House Officer concerned to follow the procedure under Section 41-A Cr.P.C. and directions issued by the Apex Court in Arnesh Kumar v. State of Bihar1.

In view of request made by learned counsel for the petitioner, I find it is proper to issue direction to the Station House Officer/Investigating Officer concerned to follow the procedure under Section 41-A Cr.P.C. and also the guidelines issued by the Apex Court in the judgment cited supra.
