THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.3124 OF 2017 ORDER:

This criminal petition, under Sections 437 and 439 of the Code of Criminal Procedure, 1973 (for short 'Cr.P.C.'), is filed by the petitioners/A.5 and A.6 to enlarge them on bail in NDPS SC No.3 of 2017 on the file of I Additional Sessions Judge, East Godavari at Rajamahendravaram (Crime No.17 of 2016 of Mothugudem Police Station), registered for the offences punishable under Sections 8(c) read with 20(b)(ii)(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the NDPS Act'). They are in judicial custody since 21.05.2016.

Sri Duvvuri Surya Narayana, learned counsel for the petitioners, while arguing the matter for some time, requested this court to direct the I Additional Sessions Judge, East Godavari, Rajamahendravaram, to try and decide NDPS SC No.3 of 2017, in accordance with law, within a time frame.

In view of the request made by the counsel for the petitioners, without touching any merits of the case, on account of dismissal of earlier Crl.P.No.1093 of 2017, I deem it appropriate to direct the I Additional Sessions Judge, East Godavari at Rajamahendravaram, to try and decide NDPS S.C. No.3 of 2017, in accordance with law, within a period of three months from the date of receipt of a copy of this order.
