The Hon'ble Sri Justice C.V.Nagarjuna Reddy and The Hon'ble Sri Justice M.S.K.Jaiswal Contempt Case No.171 of 2017 Date: 17.02.2017 Between:

Smt.T.Sita Rao .. Petitioner and Smt.M.Sathiyavathy, Secretary to Govt. of India Ministry of Labour & Employment New Delhi .. Respondent Counsel for the Petitioner : Mr.T.Koteswara Rao The Court made the following:

CVNR, J & MSKJ, J CC.No.171 of 2017 Dt: 17.02.2017 Order : (Per Hon'ble Sri Justice C.V.Nagarjuna Reddy) This Contempt Case is filed alleging willful disobedience of Order, dated 25-02-2016, in WPMP.No.7137 of 2016 in WP.No.5621 of 2016 by the respondent.

After hearing Mr.T.Koteswara Rao, learned Counsel for the petitioner, and perusing the record, we are of the opinion that this Contempt Case is wholly misconceived for the reason that by the aforementioned order, this Court has only declined to grant an interim order of suspension of Order, dated 10-09-2015, passed by the Central Administrative Tribunal, Hyderabad Bench, in OA.No.837 of 2013, granting relief of promotion to the petitioner. If the respondent has not implemented the order of the Tribunal, the petitioner is entitled to seek enforcement of the same by availing appropriate legal remedy before the Tribunal itself. In the absence of any positive order granted by this Court in favour of the petitioner, she cannot approach this Court by invoking its contempt jurisdiction.

Subject to the above observations, the Contempt Case is dismissed.
